Crimes (Appeal and Review) Act 2001 New s 63(2C) - execution of a sentence is stayed pending determination of an appeal against the disqualification of a driver licence, regardless of whether the appeal is against conviction or sentence. This amendment was a consequence of DPP (NSW) v Kmetyk (No 2) [2018] NSWCA 195.
What appeals does the District Court hear?
The District Court hears appeals of Local Court and Children's Court decisions, including care proceedings in the Children's Court.
Appeals against the sentence and/or conviction of a lower court in a criminal case can be made to the district court in certain circumstances.
